We recently released a Client Alert concerning enforcement actions by the Federal Trade Commission over EU/US Safe Harbor Framework for the cross-border transfer of personal data from the European Union to the United States. On January 21, 2014, the FTC announced settlements with 12 US companies concerning false claims the companies had made regarding their participation in the program. The FTC’s announcement demonstrates the US Government’s commitment to the Safe Harbor Framework in light of recent criticisms from the European Commission regarding the efficacy of the program. The settlements should also be seen as a warning to participating companies to keep their program certifications current.
